This limitation does not apply to liability that cannot lawfully be excluded or limited.

They do not replace or modify the terms of any separately executed brokerage agreement, property-management agreement, lease, HOA management agreement, construction agreement, purchase and sale agreement, or other contract.
Where a separately executed agreement conflicts with these Terms concerning the services governed by that agreement, the separately executed agreement controls.
